    Well, we do know that the horse was completely innocent, the bear may have been wrongfully accused and the man has a past...this is turning into a mini-drama!

    No, the cause of death for the horse is also known... blunt-force trauma from being beaten.

    The unknown is the man... and if a preliminary autopsy couldn't find obvious signs of the man being killed by the bear or obvious signs of foul play, his death might remain a mystery (then again, I never expected them to find who started the fire near Chimney Tops).

    that can be attributed to a trail that is heavy used....

    someone saw (and if im not mistaken cell phone video) the kids throw the matches...


    and hope my statement doesnt reopen the can of worms on the kids and criminal charges....

    It's a fact that an aggressive black bear ate the man. If only I could have bear spray at night in the hammock and magically teleport it home when the sun comes up.

    no proof that the bear caused the death of the man - but it still got the death penalty - the CIA has to be involved, also tied to Jimmy Hoffa

    No proof their matches started the fire as I recall.


    thats for the fires that happened in gatlinburg and surrounding......

    not in the national park..

    they were charged on the state level-------and those charges were dropped..

    they were never charged on the federal level (which, as you know, governs the Park)...

    however, pictures (and i think video) surfaced that showed some kids throwing matches along chimney tops trail...

    this is how they knew who to arrest...

    but, nothing has been proven in a court of law as state charges were dropped and no fed charges...

    That's not the way I understand it.
    The boy's matches started the fire n the park. Rumor has it that they've been given life-time bands from all national parks (but given that they were juveniles, I doubt there is any public record to support that assertion).
    But witnesses reported seeing the storm cause electrical fires.
    As I understand it, the prosecutor decided to not pursue murder/man-slaughter charges against the boys because it was going to be too difficult to show which fires were the direct cause of death.

    I don't know what the national park's decision tree looks like in these situations... but we've been told that not only did the bear eat on the man, but it was also aggressive towards park service personnel, so another nail in the bear's coffin was that he had lost a certain amount of fear of humans.

    So I don't know if becoming a man-eater is a bear death sentence, but being a man-eater AND willing to be aggressive towards man (and live near the park boundary) is.

    But that "carrion" was a man... so by definition the bear is now a man eater.
    The bear now sees man as food. By it's self, that might not have been enough to decide to put the bear down. But a man-eater being aggressive towards live man is reasonable reason enough to put the bear down regardless whether the bear had anything to do with the death or not.

    The bear population in the GSMNP is at an historic high. I don't think anyone should feel bad that a bear was shot. It's important to remember that all bears die. When people say, "the bear didn't have to die", I just roll my eyes. People will eat a burger (well done) while talking about the horrors of shooting a bear.

    The bear solution is simple. Provide a limited number of hunting permits each year so that the bear population remains at a natural level. This is done with many other animal populations.

    Keep in mind that I'm not a hunter and have no interest in killing a bear.
